PRIVACY POLICY

Fermenstation Co., Ltd. (the “Company” or “We”, as the case may be) stipulates this Privacy Policy (“Policy”), builds the framework for personal information protection, and ensures that all employees will be aware of the importance of personal information protection and commit to this Policy to facilitate such protection.

1. Definition of Personal Information.
As used herein, “Personal Information” means any information regarding an existing individual which could identify such particular individual by reference to its name, birth date or other identifier, or in combination with other information that can be easily retrievable.
2. How Personal Information is used.
We will use your personal information for such purpose (“Purposes”) as may be described below.
Customer/user information (including information regarding customers who make inquiries to us) in order to:
  1. Provide our services or goods, particularly, FERMENSTATION ONLINE STORE (“Services”), including, but not limited to, acknowledgment and inquiries about your orders, and confirmation and inquiries about our shipment of goods;
  2. Verify your identity in relation to our Services;
  3. Give guidance regarding our Services or third party’s services, or in response to your inquiries (e.g. sending DM and email);
  4. Enhance our Services (e.g. monitoring illicit activities and taking measures against them) and facilitate development of our Services or new products;

  3. Communicate with employees in relation to our business;
  4. Submit a notice or report to competent authorities;
  5. Investigate or deal with activities that are prohibited in Work Rules or employment agreements; and
  6. Accomplish any purposes incidental to the foregoing.

Information regarding applicants in order to:
  1. Carry out a screening, inform you schedule and give you the results;
  2. Conduct onboarding procedures; and
  3. Accomplish any purposes incidental to the foregoing.

Vendor information in order to:
  1. Communicate with vendors for business purposes;
  2. Pay relevant vendor fees;
  3. Investigate or deal with activities that are prohibited in contract; and
  4. Accomplish any purposes incidental to the foregoing.

Shareholder information in order to:
  1. Conduct shareholder management in accordance with the Companies Act or other applicable laws and regulations;
  2. Give notice to or communicate with our shareholders;
  3. Submit a notice or report to competent authorities; and
  4. Accomplish any purposes incidental to the foregoing.
3. Change of purposes for which personal information is used.
The Company will reasonably change purposes for which your personal information is used, and if such change is to be made, we will give a notice to relevant individual pertinent to such personal information (“Data Subject”) or make an announcement.
4. Restriction on how your personal information is used.
We will not use your personal information except as required to accomplish the purposes without the Data Subject’s consent, unless permitted by the Act on Personal Information Protection (the “Act”) and other applicable laws and regulations other than in:
  1. cases required by applicable laws and regulations;
  2. cases in which there is a need to protect a human life, body or property, and when it is difficult to obtain the Date Subject’s consent;
  3. cases in which there is a special need to enhance public hygiene or promote fostering healthy children, and when it is difficult to obtain the Date Subject’s consent; or
  4. cases in which there is a need to cooperate in regard to a state or local government, or a provider retained by them performing affairs prescribed by laws and regulations, and when there is a possibility that obtaining a Data Subject’s consent would interfere with the performance of the said affairs.
5. Proper collection of your personal information.
We will properly collect your personal information, and agree not to collect your personal information in a fraudulently or illicit manner.
6. Security of your personal information.
We will supervise our employees in an appropriate and proper manner to protect your personal information from loss, destruction, alteration, unauthorized disclosure or other risk. If we engage any third party to process any or all of your personal information, we will supervise such processor in an appropriate and proper manner to secure your personal information.
7. Provision of your personal information to third parties.
  1. We will never provide your personal information to any third party unless permitted by the Act or other applicable laws and regulations. In addition, we will use your personal information for the sole purpose of administering the affairs pursuant to relevant laws and regulations, and will not provide your personal information which corresponds to personal number and specified personal information (i.e. personal information which contains personal number) to any third party unless permitted by applicable laws and regulations.
  2. Notwithstanding the provision of Section 6 hereof, and except for cases where any of paragraphs of Section 4 hereof apply, in the event that personal information is provided to any third party (other than those which establish controls meeting such criteria as may be specified in the Regulations of Personal Information Protection Committee pursuant to Article 24 of the Act) residing in a foreign jurisdiction (other than a jurisdiction specified by said Regulations), we will obtain the Data Subject’s prior consent to allow provision of such personal information to the third party residing in the foreign jurisdiction.
  3. If we provide personal information to the permitted third party with the Data Subject’s prior consent, we will create and maintain records under Article 25 of the Act.
  4. In receiving personal information from any third party with the Data Subject’s prior consent, we will create and maintain records based on verified items under Article 26 of the Act.
8. Disclosure of your personal information.
Upon verifiable Data Subject request for disclosure of the personal information pursuant to the provision of the Act, we will without delay disclose such personal information to the verified Data Subject (or inform the verified Data Subject of non-existence of such personal information), unless we are not under obligations to make such disclosure pursuant to the provision of the Act or other applicable laws and regulations.
9. Correction of your personal information.
Upon verifiable Data Subject request for correction, addition or deletion (“Correction”) of its personal information by reasons that such information is incorrect or untrue, we will promptly conduct appropriate investigation within the scope necessary for accomplish the Purposes, and carry out Correction of the personal information based on the results and notify the verified Data Subject to that effect (or if we determine not to conduct Correction, we notify him/her of such determination), unless we are not under obligations to make such Correction pursuant to the provision of the Act or other applicable laws and regulations. In case you register in FERMENSTATION ONLINE STORE as a user, you are entitled to correct your registered personal information (e.g. your name, kana, address, phone/fax number, email address, password and place of delivery) at “My Account” in menu found in our website at https:// www.fermenstation.jp.
10. Suspension of use of your personal information.
Upon verifiable Data Subject request for suspension of use or deletion of the Data Subject’s personal information (“Suspension of Use”) pursuant to the provision of the Act on the grounds that such Data Subject’s personal information is processed outside the scope of the previously announced Purposes or collected in a fraudulently or illicit manner, or upon verifiable Data Subject request for suspension of provision of the Data Subject’s personal information (“Suspension of Provision”) pursuant to the provision of the Act on the grounds that such Data Subject’s personal information is provided to any third party without such Data Subject’s consent, and we have a good reason to believe that such request is justifiable, we will without delay conduct Suspension of Use or Suspension of Provision as the case may be, and notify him/her to that effect, unless we are not under obligations to make such Suspension of Use or Suspension of Provision pursuant to the provision of the Act or other applicable laws and regulations.
11. Use of Cookies and other technologies.
  1. We will use cookies* to provide you with better services, but will not collect any personally identifiable information and no violation of your privacy will occur.
    If you do not accept cookies, you can deactivate the storage of cookies by configuring your browser. However, you may not be able to use all functions of our services.
    *Cookies are information which is sent to your browser from a server computer and will be stored in your computer hard disk.
